Agreement to these terms
These Terms of Service (the “Terms”) govern your access to and use of MyScoreStore (the “Service”). By creating an account, listing or buying sheet music, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. You must be at least 18 years old, or the age of majority where you live, to use the Service.
A venue, not a publisher
MyScoreStore provides a platform for independent sellers to list and sell digital sheet music they upload. We are a neutral venue. We do not author, publish, endorse, pre-screen, or verify seller content, and we are not a party to the sale between a buyer and a seller. Sellers are solely responsible for what they upload, list, price, and sell.
Your account
You must provide accurate information and keep it current, keep your login credentials secure, and accept responsibility for everything that happens under your account. Notify us promptly of any unauthorized use. We may refuse, suspend, or terminate accounts at our discretion as described below.
Seller content and rights warranties
For every file, image, and description you upload, you represent and warrant that you own the work or otherwise hold all rights, licenses, and permissions necessary to sell, reproduce, distribute, and license it, and that your content does not infringe any copyright, trademark, contract, privacy, or other right of any third party. You must declare a rights basis for each work and confirm this warranty each time you publish.
License you grant to us
You retain ownership of your content. You grant MyScoreStore a worldwide, non-exclusive, royalty-free license to host, store, reproduce, watermark, display, and transmit your content as needed to operate the Service — including showing previews on your storefront and delivering watermarked files to your buyers. This license ends when you delete the content or close your account, except for copies needed to complete transactions already made or to comply with law.
Payments, fees, and payouts
Payments are processed by Stripe. Each sale is a charge made directly on the seller’s connected Stripe account, which means the seller is the merchant of record for the sale. The seller — not MyScoreStore — is responsible for the Stripe payment processing fees, for any refunds, and for any chargebacks or disputes on their sales.
Platform fee
MyScoreStore charges a platform fee on each sale: 10% for sellers on the free plan, and 0% for sellers with an active Pro subscription. The fee is deducted from the sale at the time of the transaction. Payouts to sellers are handled by Stripe under your Stripe account agreement and on Stripe’s payout schedule; MyScoreStore does not hold seller funds.
Pro subscription
Pro is an optional recurring subscription billed through Stripe at the price shown at checkout, until canceled. You can cancel at any time from the billing portal; your Pro features continue until the end of the current paid period, and we do not provide prorated refunds for partial periods. If a renewal payment fails, Pro features may be downgraded.
Taxes
You are responsible for determining, collecting, reporting, and remitting any taxes that apply to your sales or earnings. MyScoreStore does not provide tax advice.
Buyer license
Unless a listing clearly states otherwise, a purchase grants the buyer a single-ensemble license: the score may be reproduced for use by one ensemble and may not be resold, sublicensed, or redistributed. The specific license terms shown on each listing control. Purchased files are watermarked for the buyer.
Digital delivery and final sale
Purchases are delivered as digital downloads through a time-limited link. Because purchases are delivered digitally, all sales are final and we do not offer voluntary refunds from the platform. A seller may choose to issue a refund for their own sale. If a payment is refunded or charged back, access to the file may be revoked and the sale is removed from the seller’s earnings.
Acceptable use
You may not use the Service to upload or sell unlawful, infringing, or deceptive material or malware; to impersonate others; to harvest data; or to interfere with, overload, probe, or circumvent the security or normal operation of the Service. We may remove content and restrict accounts that violate this section.
Our intellectual property
The MyScoreStore name, logo, software, and the look and feel of the Service are owned by us and protected by law. These Terms do not grant you any right to use our brand or software except to use the Service as intended.
Copyright and repeat infringers
We respond to copyright concerns under our Copyright policy, which explains how to report infringing content and how a seller can dispute a removal. We maintain a policy of terminating, in appropriate circumstances, the accounts of users who repeatedly infringe.
Suspension and termination
We may suspend or terminate your access, remove listings, or close your account at any time if you violate these Terms, create legal or security risk, or as otherwise reasonably necessary. You may close your account at any time from Settings. Sales records may be retained after closure for accounting and legal purposes.
Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content sold by sellers is accurate, lawful, or non-infringing.
Limitation of liability
To the fullest extent permitted by law, MyScoreStore and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the total platform fees you paid to us in the three months before the claim, or USD $100.
Indemnification
You agree to indemnify and hold harmless MyScoreStore and its operators from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of your content, your sales or purchases, or your violation of these Terms or of any law or third-party right.
Changes to these terms
We may update these Terms from time to time. When we make material changes we will update the “last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. You agree that the exclusive venue for any dispute will be the state or federal courts located in Bexar County (San Antonio), Texas, and you consent to personal jurisdiction there, except where applicable law gives you the right to bring a claim elsewhere.
